Massachusetts Legislative Stipend Overhaul Draws Supporters and Constitutional Challenge

BOSTON -- March 17, 2026, A ballot initiative to overhaul Massachusetts's $5.4 million legislative stipend system faced expert scrutiny and constitutional challenge at a public hearing of the Special Joint Committee on Initiative Petitions on March 17. Former state Representative Jonathan Hecht of Watertown, lead proponent and original signer of initiative petition 25-37, told the committee that 145 of 200 legislators currently receive stipends ranging from $8,000 to more than $100,000 above the $82,044 base salary, all controlled by four chamber leaders, a structure he called unique in the country. The initiative would cut by nearly two-thirds the number of leader-controlled stipend positions, redirect savings to rank-and-file members on joint committees at a 20 percent base-salary rate, and condition half of all remaining stipends on committees holding public markups and votes on every referred bill. Sole opponent Sean Keeley, a Boston University School of Law professor, called the bill unconstitutional, arguing it amounts to an end run around constitutional provisions reserving rule-making authority to each chamber, and warning it could produce "a flood of litigation." Campaign finance filings showed proponents spent approximately $303,000 of $322,000 raised on paid signature gatherers. The Senate has already filed Senate Bill 3016 requesting a Supreme Judicial Court advisory opinion on the measure's constitutionality.
